Final pay and PTO in Pennsylvania

Under the Pennsylvania Wage Payment and Collection Law (WPCL, 43 P.S. Section 260.5), all final wages must be paid on or before the next regularly scheduled payday after separation, regardless of whether the employee was fired or quit. Late payments constitute a violation of state wage laws, and claims can be submitted to the Pennsylvania Department of Labor and Industry, Bureau of Labor Law Compliance. Under the WPCL, employees may also recover liquidated damages if wages are withheld past the deadline without a good faith dispute.
