Final pay and PTO in Oregon
Under Oregon Revised Statutes Section 652.140, final paycheck deadlines are among the strictest in the country and depend on separation type: if an employee is involuntarily terminated or laid off, final wages are due by the end of the first business day after discharge. If an employee resigns without notice, the employer has up to 5 business days or the next regular payday, whichever comes first. If an employee gives at least 48 hours' notice, payment is due on the last day of work. Violations can be filed with the Oregon Bureau of Labor and Industries (BOLI), and penalty wages of up to 30 additional days' pay apply for willful non-payment.
