Final pay and PTO in Arizona
Under Arizona Revised Statutes Section 23-353, final wage deadlines depend on the separation type: if an employee is discharged or laid off, they must be paid within 7 working days or by the next regular payday, whichever is sooner, while employees who quit must be paid by the next scheduled payday. Failure to pay wages on time constitutes a wage payment violation that can be filed with the Labor Department of the Industrial Commission of Arizona (ICA). Late wage payments can trigger triple damages (treble damages) if the employer is found to have withheld pay in bad faith.
Your final paycheck combines any regular wages you earned but were not yet paid with your accrued PTO payout where it is owed. Use-it-or-lose-it forfeiture of earned time is allowed in Arizona, and the window to claim unpaid final wages runs for 1 year. This calculator pre-selects Arizona so the state tax estimate is built in.
